Manitoba Provincial Court Process for Fitness Orders

 

In June, the Provincial Court changed the process for completing a Fitness Order under section 671.11(a), an order to determine the fitness of an adult to stand trial.

The matter will now be remanded in custody to the next Mental Health Court which sits Thursdays at 1:00pm, in courtroom 303.

The assessment will take place at 11:00am on the same day as Mental Health Court. An oral report will be provided to the Judge later that day in Mental Health Court.

If the person is not fit to stand trial, the matter will be remanded for possible treatment. If the person is found to be fit, their matter is remanded back to Provincial Court.

If the accused has been found to be unfit and is unlikely to become fit within 60 days, the matter will be transmitted to the jurisdiction of the Review Board.
